European Commission, argues the EU’s concentrated power—combining rulemaking, investigation, and penalties—lacks checks and balances. The outcome could set precedents for Meta, TikTok, and Google, all subject to DSA regulations for VLOPs.

X claims prosecutorial bias, alleging the Commission ignored due process. The Alliance Defending Freedom International supports this stance, framing the case as a free speech battleground. A ruling is expected to influence how platforms balance compliance with fundamental rights.
